How were these 11 individuals released on August 15th? So to understand this, we have to go back to the past. Bilkis Bano, who was 5 months pregnant lived in Dahod district of Gujarat with her husband and a three-and-a-half-year-old little girl. On February 24, 2002, she went to her father’s home in Singwad, Gujarat, for the Eid celebration. and 3 days later, on 27 February 2002, they were coming back from Ayodhya by Karsevak Sabarmati Express to Ahmedabad.

So people decided to divide into groups of 15 to 16 people They got moving and ran in all directions. so as not to be recognized. The entire family of Bilkis Bano also divides into three groups and moved in different directions.

In which Bilkis Bano, her husband and her brother moved in separate groups. The group in which Bilkis Bano moved leaving her village, had 16 people, out of which her mother and her three-and-a-half-year-old daughter was with her. These people ran away and spend the day at Ex. MLA Damor’s place. After that these people stay in a

tribal area where they wear traditional-style clothes so that they cannot be identified But on March 3, 25 to 30 people reach there with weapons in two white-coloured jeeps. Bilkis already knew these people and knew them by name because they were from Bilkis’s native place, where she had lived since childhood.

Now the rest of their group run away but Bilkis was pregnant, her daughter was young and her mother was very old. so they fail to escape and 7 people were stuck at that place. Out of these 25 to 30 people, there were 12 people who raped Bilkis Bano and her mother. and killed her three-and-half-year-old daughter, they also killed the other survivors.

These people thought Bilkis Bano was dead But after 3 to 4 hours, when Bilkis Bano regains consciousness her entire family’s corpses were sprawled around her. she hides there the whole night under the cover of a tree and the next day in the same tribal village, she took clothes from the women and she saw a man in uniform he was a home guard,

Bilkis Bano tells the whole story to the home guard The home guard takes her to Limkheda police station. At first, the police attempted to protect the offender by failing to file an FIR. Som Singh, the police officer writes the complaint by modifying the story told by Bilkis, And this came to light only after the CBI inquiry.

The rest of the people present there confirmed that the story told by Bilkis and what is written in the complaint are different. Bilkis Bano was not literate, so whatever she said, he wrote the complaint and modified it, and got her thumb stamp on it The police stated that this case lacked validity and also submitted its closure report. After this, Bilkis Bano is shifted to

Iqbal Relief Camp and there she tells her story to the people. Sugra Ben and Latifa Ben Jyoti was the organizer of the camp, took her story forward many NGOs get involved, it created enough pressure that the Supreme Court ordered for CBI investigation. CBI investigated everything and submitted the Charge sheet.

In this case, the police were protecting the criminals from the beginning, by hiding their names. Now the people who attacked were from the village of Bilkis. Bilkish knew their names, knew them and had their names written even while complaining. But Som Singh did not mention all these names in the complaint. And tried to end the case by portraying it as a mob assault.

CBI has confirmed on paper that doctors were also involved The doctor submitted the manipulated report of Bilkis Bano, And the State Forensic Science Laboratory which is in Vadodara confirmed that whatever Bilkis Bano has told is true, it was a rape. There were so many injuries in the medical report of Bilkis Bano CBI had imposed this many sections And the statements of this many witnesses have been submitted by the CBI. In this, the timing of the crime was also manipulated by the police,

so that it benefits the criminals The timings mentioned in FIR No. 59/2002 by Mr. Som Singh did not match the Police journal dairy details, The process of identifying the body by taking Bilkis Bano on the crime scene was skipped no one visited the crime scene for the whole day.

And the dead bodies were also manipulated On March 4, Bhavin Patel, the photographer of the crime scene, the pictures he captured of the crime scenes it has the pictures of Bilkis Bano’s daughter’s dead body the name of her daughter was Saleha her name is also mentioned, and on the other hand, the pictures captured by the photographer RK Soni, has no pictures of her daughter’s dead body, How can a photograph of the same crime scene be different? the name of the daughter of Bilkis Bano is not even mentioned. AllMS and CFSL teams from New Delhi who visited the entire crime scene. they clearly said that the manner in which the bodies were kept the bodies were for sure tampered Community Health Center which is near Limkheda Police Station Despite the availability of staff there, the post-mortem was not done. rather, Evidence were manipulated. Even the CBI had to get all the dead bodies out of the graves again. So after it was concluded that the body parts have been interchanged.

so that the bodies cannot be identified. Bilkis Bano was getting threats to withdraw this case, That’s why Bilkis Bano requested the court that this case should be transferred outside Gujarat. And this request was accepted by the court. and the case was shifted to Mumbai. and the case was scheduled in Mumbai, On January 4, 2008, 11 people were sentenced to life imprisonment.

Among these 11 people were the policemen who had made the wrong report, there were also doctors who had submitted the manipulated medical report. The lower court reviewed all the evidence and sentenced these 11 people to life imprisonment.

And the court ordered the Gujarat government that Bilkis Bano should be given compensation of 50 lakh, a house, and a job. Later, these 11 people go to the High Court, then there the whole case is reviewed, all the evidence is seen. And they were sentenced to life imprisonment, After that, they went to the Supreme Court, filed a review petition in the Supreme Court and appealed again. In total, three courts of India, Lower, Higher and Supreme Court, 5 times verified the details of this case, all the witnesses.This means that by no means is there any doubt that they have not committed a crime.

11 criminals were released

It is completely confirmed that they committed the crime. And this is the reason, they were serving a life sentence for 14 years. But now the thing is, what is the reason that these 11 criminals were released on August 15th. According to Article 72 and 161, The President of India and the State governor has the right to waive the sentence given by the court. But in this case, they have not given an apology, but the Gujarat government has given an apology.

Because under CRPC section 432, the state government also has the right to waive the punishment. And whenever there is an anniversary of a big leader, be it 26 January or 15 August, the prisoners are released. Similar is the Gujarat Amnesty policy under which amnesty is given.

So, one of the 11 accused has filed the application That we are serving the sentence for 14 years now we should be given the amnesty. Gujarat government sent this request to the Supreme Court, So at first it was debated that if this whole case is going on in Mumbai then Gujarat Government has no role in it. Then the Supreme Court stated that the Gujarat government will decide because Gujarat is where the crime was committed. An amnesty policy was made in Gujarat in 1992.

Which was amended in 2014, The Gujarat government formed a committee in which the leader, senior judges were in the committee and together they pardoned all these 11 prisoners. And these people were released from prison. When these people reach the village, they were welcomed with flowers and garlands and sweets were distributed. And their welcoming pictures were viral on social media. Now the question is asked to the Gujarat government that why only these 11 offenders were released compared to the other prisoners?

Because according to the Gujarat amnesty policy, those who kill two or more than two people cannot be pardoned. and here 7 people were murdered. it is clearly mentioned in the policy, that rapists cannot get pardoned. if the central agency is involved, then even in such a case, there should not be an apology.

But here the punishment was stated by the CBI, so all the questions were raised. On this, the Gujarat government said that the apology given to these people is not given on behalf of the Gujarat amnesty policy 2014, but on the basis of the Gujarat amnesty policy 1992. Because this case is before 2014. And the instructions for pardoning in the Gujarat amnesty policy in 1992 is not clear. It has not been mentioned for what reason the apology should be given.

Just a few suggestions are made, but nothing is clearly stated, In this June 2022, the Home Ministry has sent a letter to every state government that no rapist should get pardon at any cost. Shobha Gupta, who is the lawyer of Bilkis Bano, has said that, she will file PIL against this. So this was the whole story of Bilkis Bano.
